This form is for ADULT children and other ADULT family members who are NOT listed on the Family Release of Liability who may participate in Eagles events.

Parents and minor children only need to complete the Family Release of Liability. 

EAGLES Homeschool Group Release of Liability

In exchange for participation in EAGLES Homeschool Group LV Inc. (hereafter EAGLES) events, activities and/or the use of the property, facilities, and services of EAGLES, I agree for myself a to the following:

1. Agreement to follow directions. I agree to observe and obey all posted or stated rules and warnings, and further agree to follow any oral instructions or directions given by EAGLES, or leaders, members, instructors, employees, representatives, or agents of EAGLES.

2. Personal Skill & Insurance. I certify on behalf of myself that Ie have sufficient skill and fitness to participate in the activities offered by EAGLES. I further certify that I have no medical, mental or physical conditions which could interfere with my safety or ability to participate in these activities, or else I are willing to assume and bear the cost of all risks that may be created, directly or indirectly, by any such condition. I further certify that I have adequate insurance to cover any injury, damage or emergency transportation or search and rescue costs I may cause or suffer while participating, or else agree to bear the costs of such injury, damage or emergency transportation costs ourselves.

3. Assumption of risk & release. I recognize that there are both known and unanticipated inherent risks associated with the above described activities and I assume full responsibility for personal injury to myself and further release and discharge EAGLES for sickness, bodily injury, death, emotional injury, personal injury, property damage, or financial damage arising out of my use or presence upon facilities of EAGLES, whether caused by the fault of myself, my family, EAGLES, or other third parties.

4. Indemnification. I agree to release and to indemnify, defend, and hold harmless EAGLES for any and all injuries, claims, causes of action, damages, judgements, costs or expenses, including attorney fees and other litigation costs, which may in any way arise directly or indirectly out of any of the described activities or transportation to and from such activities, whether such injury arises out of the negligence of myself, my family, EAGLES, or other third parties.

5. Agreement Not to Sue. I agree not to sue EAGLES for any loss, injury, costs or damages of any form or type, howsoever caused or arising, and whether directly or indirectly, from my participation in any aspect of the said events and related activities

6. Dispute resolution. The parties will attempt to resolve any dispute or claim of damage arising out of or relating to this Agreement through friendly negotiations amongst the parties. If the matter is not resolved by negotiation, the controversy or dispute will be submitted to mediation in accordance with statutory rules. If mediation is not successful, any outstanding issues will be submitted to final and binding arbitration under in accordance with the rules of the American Arbitration Association.

7. Applicable Law. Any legal or equitable claim that may arise from the participation in this agreement shall be resolved under Nevada law.

8. Medical Authorization. In the event of an injury during EAGLES activities, I give my permission to EAGLES to arrange for all necessary first aid, medical treatment, or service for which I shall be financially responsible if I am not able arrange such medical or treatment.

9. Fees. I agree to pay all damages to the facilities of EAGLES caused by negligent, reckless, or willful actions by me or my family.

10. Enforceability. The invalidity or unenforceability of any provision of this Agreement, whether standing alone or as applied to a particular occurrence or circumstance, shall not affect the validity or enforceability of any other provision of the Agreement or any other applications of such provision, as the case may be, and such invalid or unenforceable provision shall be deemed not a part of the Agreement.

11. No Duress. I agree and acknowledge that I am under no pressure or duress to sign this Agreement, that I have been given a reasonable opportunity to review it before signing, and that I am free to have my own legal counsel review this Agreement if I so desire.

12. Consent. I, agree to all the terms and conditions of this agreement. 

I HAVE READ AND UNDERSTAND THIS AGREEMENT AND AM AWARE THAT BY SIGNING THIS AGREEMENT I ARE WAIVING CERTAIN SUBSTANTIAL LEGAL RIGHTS WHICH I AND MY HEIRS, NEXT OF KIN, EXECUTORS, ADMINISTRATORS AND ASSIGNS MAY HAVE AGAINST THE RELEASEES EITHER INDIVIDUALLY OR COLLECTIVELY.
